A recent highlight was serving as lead counsel for a coalition of environmental groups that successfully persuaded the New Mexico Environmental Improvement Board to adopt the Advanced Clean Cars rule, which requires automakers to deliver an increasing number of zero emission vehicle to the state. Other representative matters include briefing the D.C. Circuit and the U.S. Supreme Court regarding U.S. Environmental Protection Agency’s “good neighbor plan” to reduce interstate air pollution and briefing and arguing several complex federal appeals related to EPA’s air quality designations for ozone, 

While much of his federal experience has come in climate and clean energy cases, David maintains a broader federal appellate practice. He is admitted to practice before three federal courts of appeals: the Tenth Circuit, the Fifth Circuit, and the D.C. Circuit, and routinely briefs and argues civil appeals in these courts.
